General terms

CONTENTS OF CONDITIONS


The general conditions for offering services for accommodations and other travel arrangements are part of the contract between Travel Tourist Ltd, as a travel agency or authorized agent, and the traveler who accepts the offered arrangement.

Everything that is listed in the general conditions represents a legal commitment for the guests, as well as for Travel Tourist Ltd.


Travel Tourist Ltd. commits itself to undertake all precautions to offer true information to its users. All the information, data, and pictures that are related to the capacity of accommodations, Travel Tourist Ltd. collected from the most reliable accommodation facilities. Even though all information are controlled by employees of Travel Tourist Ltd., the Agency does not take responsibility for mistakes, negligence, and delays made on the web.

1. DESCRIPTION OF THE SERVICE

The accommodation units are described according to the official evaluation given by the local tourist organization during the issue of the working license.

The standards of accommodation, nutrition, service and others, of places and countries are different and cannot be compared. Travel Tourist Ltd offers those services listed on its Internet web page, which is not necessarily equal to those services offered by other selling points.

2. PRICES OF ACCOMMODATION

Price of the service includes the basic service as described in the price list for the booked accommodation unit. Additional services are those services that are not included in the price of accommodation. Additional services and special requests must be made during the reservation.
The prices of the accommodation units are given in Euros. Travel Tourist Ltd has the right of changing the given prices if the accommodation facility changes the prices of the accommodation. The prices stated in our offers are based on a contract basis with our partners and do not necessarily respond to the prices on the spot in the accomodation where the traveler resides, and any difference in price can not be a complaint.


3. RESERVATION AND PAYMENTS

Inquiries and reservations of accommodation are accepted electronically and by telephone. During the reservation procedure the traveler is obligated to provide all necesary informatons in the form reqired for the reservation. Travel Tourist Ltd assumes no responsibility for the accuracy of the data given by the traveler during the registration. In order to confirm the reservation, the traveler pays an advance rate that ranges from 15% to 30% of the reservation. The remaining amount of the reservation, must be paid no later than 21 days prior to arrival or be paid directly on arrival to the owner of the accommodation unit, unless in the offer its otherwise stated. If the date of arrival is within 21 days it is necessary to pay 100% of the amount for the requested and confirmed service. Payment can be made by bank transfer to the bank account of Travel Tourist Ltd. or on-line payment by credit card. Bank transfers from abroad must be made no later than five days prior the arrival of guests and from Croatia at least three days prior to guest´s arrival. With the payment the reservation becomes valid, any other confirmation given in written or orally is not valid as a reservation.

After receiving full payment for the chosen service, the traveler will be sent a voucher as confirmation. The voucher serves as a proof that the reservation of the service has been carried out. The traveler has the obligation to give the voucher upon arrival to the unit. If more people wish to be added to the accommodation than those listed on the voucher, the accommodation facility has the right to refuse the accommodation to the travelers that are not registered, unless they agree to pay all the additional charges that may apply.

With the payment of the reservation the traveler confirms that he understands all the conditions that may apply to the specific accommodation unit. With payment of the reservation the traveler confirms that he accepts the general conditions of the offered accommodation service. Furthermore, the traveler understands and confirms that a kind of travel insurance was offered to him. With payment of the reservation, the agreement becomes a legal obligation to the traveler as well as to Travel Tourist Ltd.

4. TRAVEL DOCUMENTS

Passengers are required to have valid personal documents such as passports. Invalid documents, which have resulted in cancelation of the journey, are not producing any harmful consequences for the Travel Tourist Ltd., but and if the omission of such passengers Travel Tourist Ltd. suffered additional damage, the customer is obligated to reimburse the same. All costs for loss or theft of the documents during the travel period are carried by the traveler. If the trip requires a visa, Travel Tourist Ltd. may mediate in obtaining them with a special supplement. Travel Tourist d.o.o. is not responsible for the decisions of the customs and police and other government bodies that the passenger does not allow entry into a particular country.

5. ACCOMODATION IN ROOMS/APARTMENTS

The service provider will gie you the key of rented accommodation units. Arrange of rooms / apartmets are determined by reception / service provider in the place of residence. If the passenger has not arrange a special kind of room / apartment, he will accept any officially registered accommodation facility for the issuance of each object described in the catalog and price list.
Accommodation in the room usually its not possible before 2 pm on the day of arrival, and the same usually must leave by 10 am on the day of departure.
Arrivals after 8 pm is necessary to announce in advance, unless otherwise indicated.

6. RESPONSIBILITY OF TRAVEL TOURIST LTD


The Agency is responsible for services and the choice of service providers, while respecting the rights and interests of passengers, according to the traditions of the tourism industry.
Travel Torist Ltd shall ensure that the traveler gets all the reserved services and, therefore, has to answer to the traveler in case of non-performance of the services expected.

7. RESPONSIBILITY OF TRAVELER

The traveler commits itself to the following:

- to have on hand all valid travel documents.
- to respect the customs formalities, and the rules for the foreign currency of the Republic of Croatia, as well as other countries visited during the travel. In case that the traveler is not able to proceed his travel because of the violation of regulations, the traveler has to pay for any costs that incurred.
- travel to countries that require mandatory vaccination against certain diseases traveler is required to hold certificates and documents on immunization
- to respect the rules and regulations of the rented accommodation unit, and to collaborate with the Accommodation facility accordingly.
- upon arrival to the rented accommodation unit, the traveler is expected to present the given voucher, where the number of people and type of service to be offered are specified.
- inquire whether his entry into the country in the destination country or neighboring countries require a visa

In case these obligations are disregarded, the traveler is responsible for all additional fees that may apply, and for all damages the traveler caused, and is bound to pay the damages to the service provider on the spot.

8. THE RIGHT OF TRAVEL TOURIST LTD TO CHANGE AND CANCEL

Travel Tourist Ltd commits itself to assure to the traveler the accommodation in the reserved period, except in case of exceptional circumstances (war, riot, strike, terrorist activities, sanitary troubles, bad weather, intervention of the authorities etc.)

Travel Tourist Ltd can offer changes to the reserved accommodation or cancel the accommodation completely or partly, if before or during the time of the stay special circumstances appear that can not be avoided or declined.

Travel Tourist Ltd has the obligation to immediately inform all arriving travelers about changes to the reservation or cancellation, and if no alternative accommodation can be found, to refund the amount paid by the traveler less the administrative charges of the agency.

9. THE RIGHT OF THE TRAVELER TO CHANGE AND CANCEL

Any change of accommodation unit and any change before using the service is considered a cancellation of the reservation.

The cancellation costs will be as follows:

- For the cancelation 30 days prior the arrival TRAVEL Tourist Ltd charges 15% of the whole amount of the reservation, and minimum 15,00 euro

- For the cancelation from 29 to 22 days prior the arrival, Travel Tourist Ltd charges 30% of the whole amount of the reservation

- For the cancelation from 21 to 15 days prior the arrival, Travel Tourist Ltd charges 40% of the whole amount of the reservation

- For the cancelation from 14 to 8 days prior the arrival, Travel Tourist Ltd charges 80% of the whole amount reservation

- For the cancelation from 7 to 0 days prior the arrival, Travel Tourist Ltd charges 100% of the whole amount of the reservation

- If the traveler does not arrive to the destination or cancels the service of the accommodation after it began, Travel Tourist Ltd charges the full price of the reservation.



For every cancellation of the reservation Travel Tourist Ltd charges 25 EUR of manipulative expenses.

If the traveler has to cancel within 7 days before using the service, Travel Tourist Ltd offers the traveler a possibility to find a new user for the same reservation (if it is possible), in which case Travel Tourist Ltd charges only for an exchange fee. The new user has all the responsibility from these "General conditions".

If the Traveler does not arrive until midnight on the day of service, and has not informed the agency or the host, the reservation will be canceled and the cancellation costs will be calculated as described above.

If the costs of the accommodation are in fact higher than what was initially given, Travel Tourist Ltd has the right to charge the difference. The above mentioned cancellation fees are used primarily for the changes of the reservation, but also for all other essential changes.

The agency does not reimburse to the traveler the costs incurred over procurement of passports or visas, related to the reservation that the traveler cancels.


In case that the traveler cancel or shorten a trip due to weather conditions, Travel Tourist Ltd. will apply the above scale, and subsequent complaints will not be acknowledged.

10. INSURANCE IN CASE OF CANCELLATION OF RESERVATION

If, during the reservation, the traveler expects he could cancel the reservation for some reason, Agency recommends Cancellation insurance. Cancellation insurance can´t be paid afterwards, only during initial request for the travel. Insurance premium depends on the cost of the travel, and according to the price list of the insurance company Agency has the contract with.

Cancellation insurance is only valid in the following cases and the mandatory written statement:

- Death
- accident with serious injury
- sudden acute illness, which required urgent medical caredisorders of pregnancy
- failure of the vaccine, which the insured was required to receive mandatory, according to the regulations of the country to which travel
- damage to property caused by fire, natural disasters or intentional criminal act by third parties
- drill.


High-risk individuals in terms of these provisions are considered:

- Insured life partner (spouse)
- children,
- parents,
- brothers and sisters,
- grandparents and life partners of the insured person only in case of death

Travel Tourist Ltd is an intermediary for making insurance policies of insurance company Allianz d. d. Terms of cancellation and other information are available in PDF format on Allianz web pages - articles 41 - 44 on page 18 and 19.

In case the traveler does not have insurance, the Agency has a duty to compensate the traveler according to the law of Article 9 of this contract. With the payment of insurance traveler moved all her/his rights to the insurance company that owns the cancellation insurance policy cancellation and the agency is required to provide the customer all documents necessary for the realization of customer requests. All other rights are in the insurance policy that we encourage all customers to read carefully.

11. TRAVEL INSURANCE

The cost of travel does not include the package of travel insurance: insurance against risks of accidents and diseases, travel insurance from loss or damage of luggage as well as health insurance.

Acceptin and paying the reservation it is considered that the customer has been provided and recommended all types of insurance listed above.

If the traveler requires insurance, insurance can be contracted directly with one of the insurers or with the agency. In this case, the agency only acts as intermediary. We recommend that you read conditions of insurance prior to purchase.

12. LUGGAGE

Luggage is carried at the risk of the traveler and therefore a luggage insurance is recommended.

Travel Tourist Ltd is not responsible for damage or loss of luggage, for theft of luggage, or valuables left in the accommodation unit. Reports for damage or loss of luggage should be made to the accommodation facility and to the nearest police station.

13. SOLVING COMPLAINTS

If the traveler is not satisfied with a specific situation upon arrival, he can inform the service provider (receptionist or owner of accommodation, etc.) . Every traveler has the right of complaint for not getting the paid service. Every traveler, holder of the contract, has the right to complain to the non-performance of the agreed service. Every complaint has to be submitted separately by the traveler.

If the service will not be inproved even after the complaint, the traveler must require a confirmation from which is visible that the services offered are not entirely fulfilled, or below the quality standard. The confirmation must be submit with a written complaint.
Within 8 days after returning from the trip the client has to deliver a complaint in writing to the headquarters of Travel Tourist Ltd.

Travel Tourist Ltd will consider only complete and documented complaints received within 8 days from returning customer.

To resolve complaints on services abroad you must to respect the rule of registration of the complaint with issuance of certificates on the spot and the deadline for filing the complaint. The Agency shall make a written decision on the complaint within 14 days upon receipt of the complaint, and may postpone the decision of the complaint deadline of 14 days to collect information. The agency will take into consideration only those complaints that could not be rectified on the spot or while traveling.



While the solving of complaint lasts, at most 14, that is 28 days after the complaint is made, the traveler will not use any other person, UHPA, or other institution, or giving information in the media. Also, during this period, the traveler agrees not to sue.

The highest compensation regarding a complaint can be the amount of the objected part of the service, but cannot cover already used services or the complete amount for the accommodation used.

14. COMPETENCE OF THE COURT OF JUSTICE

The traveler and the agency will try to solve any disputes in good will, however in case of a judicial dispute, the court of justice is located in Pula, with relevant law being Croatian law.

15. INSURANCE IN CASE OF INSOLVENCY OR BANKRUPTCY OF TRAVEL ORGANIZER


In accordance with the Act on the provision of services in tourism, in the event of insolvency or bankruptcy of Travel Tourist Ltd., passengers caught on the trip as well as persons who paid in advance for their travel should contact the insurer with which the Travel Tourist Ltd. has signed a contract securing bail for a travel package (Allianz Zagreb dd, Podružnica Pula, Insurance policy no. 1500-171852607).

16. Liability insurance

In accordance to the Law on Providing Services in Tourism, Travel Tourist Ltd has concluded a contract with the insurance provider Allianz Zagreb d.d. regarding liability insurance for damage induced upon the traveler due to the failure to realize, to partially realize or to disorderly realize the obligations relating to the package travel arrangement.

17. Protection of personal data

The traveler voluntarily renders personal data. Personal data of the traveler are necessary in the realization process of contracted travel arrangements and shall be used for further communication. Travel Tourist Ltd obliges that personal data of the traveler will not leave the country except for the purpose of realizing contracted travel arrangements. An exception to providing personal data to third persons applies to concluding a travel insurance policy, i.e. if the traveler concludes an insurance policy, his data will then be forwarded to an insurance provider. The traveler´s personal data will be stored in a database of Travel Tourist Ltd. The traveler shall agree that his personal data may be used for the purpose of Travel Tourist´s marketing actions.
